Privacy Policy – 58th Floor AI

This Privacy Policy explains how 58thfloor.app ("58th Floor AI", "we", "us") handles your information when you use our website and AI video generator. By using the service you agree to the practices described here.

Information we collect

• Account information — your email address and, if you sign in with Google or another provider, the basic profile details that provider shares (name and avatar).
• Uploaded photos — the two face photos you upload to create a video. Because they show people's faces, we treat them as sensitive and use them only to generate your video. We do not create face templates or use them to identify anyone.
• Generated videos — the AI videos created from your photos, stored in your account.
• Payment information — purchases are handled by our payment processors (Stripe or Creem). They collect your card or payment details directly; we never see or store your full card number. We receive an order record (amount, currency, status, and the email used at checkout).
• Usage and device data — pages visited, features used, approximate location derived from IP address, browser and device type, and error logs.
• Cookies — essential cookies keep you signed in and remember your language. If analytics is enabled and you consent where required, analytics cookies or similar technologies help us understand how the site is used. You can change your choice at any time through Cookie Settings in the footer.

How we use your information

• To create your account, sign you in and keep it secure.
• To generate your 58th Floor style video from your uploaded photos and deliver it to you.
• To process purchases, manage credits and refund failed generations automatically.
• To answer support requests and send essential service emails (for example, sign-in links or receipts).
• To prevent abuse, fraud and violations of our Terms of Service.
• To measure and improve the service in aggregate.

We do not sell your personal information, and we do not use your photos or videos to train our own AI models.

Service providers (subprocessors)

We share data only with providers that help us run the service, and only as needed for their task:

• AI video generation providers — your photos and generation instructions are sent to third-party AI providers (currently APIMart, using the ByteDance Seedance video model) to produce your video. These providers process the files on our behalf.
• Cloud storage and hosting — Cloudflare (including Cloudflare R2) stores uploaded photos and generated videos and hosts the website.
• Payment processors — Stripe and Creem process payments under their own privacy policies.
• Email delivery — a transactional email provider sends account and receipt emails.
• Analytics — if enabled, Google Analytics and/or Plausible collect usage statistics.

Some of these providers operate in other countries. Where data is transferred internationally, we rely on the safeguards those providers offer.

Retention

• Uploaded photos are deleted automatically 7 days after upload.
• Generated videos are kept privately in your account for 30 days, then deleted automatically. Download any video you want to keep.
• Account and order records are kept while your account is active and afterwards as long as needed for accounting, tax, fraud prevention and legal obligations.
• Logs and analytics are kept for a limited period and then deleted or aggregated.

Your choices and rights

You can download your videos from My Videos at any time. You can ask us to access, correct or delete your personal data, including your account, photos and videos, by emailing support@58thfloor.app from the email address on your account. We will respond within a reasonable time and in any case within the period required by applicable law. Depending on where you live, you may also have the right to object to or restrict processing, to data portability, and to complain to your local data protection authority.

Photos of other people

Only upload photos of yourself or of people who have given you permission. Do not upload photos of anyone under 18. If you believe a photo of you was uploaded without your consent, email support@58thfloor.app and we will remove it.

Children

The service is not intended for anyone under 18, and we do not knowingly collect personal data from children. If you believe a child has provided us data, contact us and we will delete it.

Security

Photos and videos are stored privately and are only accessible to your account and to the providers that process them for you. We use encrypted connections (HTTPS) and access controls, but no system is perfectly secure.

Changes to this policy

We may update this policy as the service changes. We will post the new version on this page with a new "last updated" date, and notify you of significant changes where appropriate.
