Terms of Service – 58th Floor AI

These Terms of Service ("Terms") govern your use of 58thfloor.app ("58th Floor AI", "we", "us"), an AI tool that turns two photos into a short 58th Floor style duo rap video. By creating an account or using the service, you agree to these Terms and to our Privacy Policy.

Eligibility and accounts

You must be at least 18 years old to use the service. You are responsible for your account and everything done through it. Keep your sign-in method secure and tell us at support@58thfloor.app if you suspect unauthorized use.

Your photos and consent

By uploading a photo you confirm that:

• the photo shows you, or a person who has given you clear permission to upload it and to appear in an AI-generated video;
• nobody in the photo is under 18;
• the photo is not of a public figure or celebrity, and you are not using the service to impersonate any real person;
• you have the right to use the photo and it does not infringe anyone's privacy, likeness or copyright.

You are solely responsible for the photos you upload and for how you use the resulting videos.

Acceptable use

You may not use 58th Floor AI to create or share content that:

• is sexual, nude, violent, hateful, harassing or discriminatory;
• defames, bullies or misleads people about what a real person said or did;
• is used for fraud, scams, political deception or fake endorsements;
• violates any law or the rights of others.

You also may not attempt to bypass credit checks, abuse refunds, scrape or reverse-engineer the service, or overload our systems. We may refuse a generation, remove content or suspend accounts that break these rules.

Credits, prices and payment

• Credits are sold in one-time packs in US dollars: $9.99 for 1 video, $24.99 for 3 videos and $49.99 for 7 videos. There is no subscription.
• Each video uses 10 credits. Credits never expire, have no cash value and cannot be transferred or resold.
• Payments are processed by Stripe or Creem. Prices may change in the future, but a change never affects packs you have already bought.

Refunds

• Failed generations — if a video fails to generate, the credits are returned to your balance automatically.
• Unused packs — if you have not used any credits from a pack, you can request a full refund within 7 days of purchase by emailing support@58thfloor.app with your order email.
• Used credits — credits spent on a video that was successfully generated are non-refundable, including when you are unhappy with the creative result. Following the photo guide gives the best results.

Nothing in these Terms limits any refund right you have under the consumer law that applies to you.

Your videos

Subject to these Terms, you own the videos you generate (except the soundtrack, which is covered in the next section) and may download and post them, for example on TikTok, Instagram Reels or YouTube Shorts. You give us a limited license to store, process and display your photos and videos only as needed to provide the service to you. We do not use your content in our marketing without your permission. Videos are deleted after 30 days and photos after 7 days, as described in the Privacy Policy; download anything you want to keep.

AI results can vary. Faces, motion and details may not always look exactly like the people in the photos.

Music and affiliation

Generated videos come with the original 58th Floor sound. The soundtrack is licensed to us for use only within videos created on 58thfloor.app, and you may use it as part of those videos for personal social sharing. You may not extract, remix or redistribute the audio separately, or use it for any other purpose. The rules of the platform you post on still apply, including any content or music policies it enforces.

58th Floor AI is an independent creative tool inspired by a popular music trend. It is not affiliated with, endorsed by or sponsored by COLORS, the artists or their labels, and it does not use their performance footage. All trademarks belong to their respective owners.

Third-party services

The service relies on third-party providers for AI processing (such as APIMart and the ByteDance Seedance model), storage (Cloudflare R2) and payments (Stripe, Creem). Their availability is outside our control.

Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Termination

You can stop using the service at any time and ask us to delete your account. We may suspend or end access if you breach these Terms. Unused credits on accounts closed for a breach are forfeited.

Changes and governing law

We may update these Terms; the new version applies once posted on this page. These Terms are governed by the laws applicable at the operator's place of business, without prejudice to mandatory consumer protections where you live.
